Great perspective. Newsweek said they would no longer use anonymous sources after the Koran toilet flushing story. What I don't understand about that story is that the reporter did call the Pentagon and they didn't refute the claim. This was before the story came out. I am not sure they needed to apologize. They probably should not have published until they got a source with cojones.

What makes the Plame leak different is that the leaker may have broken the law when passing on her identity to reporters. Is a a reporter required to be an accomplice to a crime to protect a source? Rove and Libby also claim that they dropped their claim of confidentiality to any reporter they talked to about Valerie Plame. This leads me to believe that either Karl and Scooter didn't leak to Miller or that she was the one who leaked it to them. There is a third source in the White House who talked to Walter Pinkus of the Washington Post. Maybe that source was Miller's also. Both Pinkus and his source are said to have testified to the Grand Jury in this case.

My gut feeling is that Miller is not protecting her journalistic integrity. I think she has too much information. I think she is either protecting herself or someone else for the wrong reasons. There is so much riding on this case. The credibility that she helped build for the administration is sinking and she might be willing to go down with the ship. If the investigation proves no wrong doing then she is safe. She could be safer in jail at this point.

Although there have been leaks regarding this investigation I believe Fitzgerald is holding back on the good stuff.

Rovegate may be best remembered for its effect on very long-standing American journalistic traditions. The decision by the Time Chief Editor to provide notes to the Fitzgerald grand jury was a watershed moment. Before that, it had always been heresy for any journalist to forsake confidentiality agreements and testify before a grand jury – no matter what. A very excellent article in last week’s Wall Street Journal sorts this out. One of the factors accrues from our digital times. Reporter Cooper had used a Time computer and kept electronic notes (who doesn’t these days?). As a result a criminal complaint could have been issued against Time-Life. Generally reporters’ notes were always kept on reporters’ notebooks and were considered personal property. The bigger moral issue was also at stake – should reporters always be backed even when issues of national importance are involved – or the reporters are jerks? It was disclosed by the WSJ for example that Cooper is married to a high-ranking Democratic Party strategist. Over at the New York Times, Judith Miller had other issues – such as a separate investigation over her involvement in reporting on a potential Islamic front. Plus she was one of the lead reporters sandbagged by Bush on WMD – and was sanctioned for it.

My own take as a life-long journalist—Reporters have historically had complete discretion to make commitments to keep sources confidential. As a result they are used by people like Scooter Libby and Karl Rove to leak information they would never say in public – or take responsibility for. Bad system. Best-in-class organizations now tell reporters they may only quote sources willing to be ON THE RECORD. No balls, no ink. That was my position with my staff in recent years. There may be an exception – such as Deep Throat – but those situations are rare.
